Neutrog Pleads Guilty to Environmental Breaches

Fertiliser producer Neutrog Trading Pty Ltd has pleaded guilty to three offences under the Environment Protection Act following a prosecution by the Environment Protection Authority.

The EPA alleged that between the 28th of July 2022 and the 5th of September 2023, Neutrog intentionally or recklessly polluted the environment and caused an odour nuisance affecting the townships of Kanmantoo and St Ives. The charges also relate to failing to comply with a condition of its environmental authorisation.

According to the EPA, the company repeatedly exceeded approved stockpile heights, with spent litter and compost stockpiles rising above three metres, and repeatedly received unauthorised waste, including almost 40 tonnes of waste coffee grinds.

Neutrog has now accepted liability and entered guilty pleas in the Environment, Resources and Development Court. The matter has been adjourned for submissions on penalty, which will be heard on the 17th of June 2026.

EPA Director of Compliance, Circular Economy and Investigations Steven Sergi said the case was a reminder for businesses to adhere to licence conditions and environmental regulations.

“The EPA emphasises the importance of compliance with environmental laws to protect the community and the environment,” he said.

The guilty pleas follow ongoing community concern in Kanmantoo about odour from the fertiliser plant, particularly during warmer months. In previous statements, Neutrog has said it is committed to reducing odours, has stopped receiving compost material on the northern side of its site and has lodged plans for a shed to better contain smell.

Neutrog employs 68 local staff and has operated in the Adelaide Hills for almost four decades.
